I bought a property in Aug. 2008. Since it was a model house, the builder had been the owner of the property for more than two years. When the ownership was transferred to me last August, I had to pay the builder's tax rate. Builders pay 15% more property tax that normal residents. Moreover, as housing price is dropping, the property was assessed at a much higher value before I bought it. So I ended up paying about $3000 more taxes than what I should pay. My question is how I can get this overpaid tax back.

补充一点:taxable value不能高于房屋估价,所以如果按2.3%通胀率算得的今年的taxable value比估价高,那么,就让taxable value=assessed value.这时打税就按下降的房价来算。

房价跌房税不一定跌,根据94年的Proposal A,地税是与房子的Taxable Value挂钩,而不直接与房子的估价挂钩,尽管它们之间也有一定的联系。Taxable Value主要是与通货膨胀率有关。每年的通胀率都是多多少少涨一点的,今年大概是2.3%,所以虽然你的房价掉了5%或10%,但你的Taxable Value较去年的还是涨了2.3%,所以地税也要涨一点点。如果你觉得你的地税过高,最好是与周围的房子的地税比较,如果比周围房子高出许多那就说明高收了。每年春天收到新的交税通知时,账单上有说明如果对征税有异议的可以去XX地方申述,那是一个申述的最好时机,过了这个时机就不好弄了。

你可以写封信或亲自到你所在城市的City Hall 或Township那里去申请退款,写清你的理由。他们收到你的请求后会秉公办事看看是否多charge你了。这个过程大概需要花4到6周,但不复杂。如果他们拒绝你的申请也会给予你解释。
